
A judge has ruled in favor of Assessor Erica Munson in her lawsuit against the City of Dunkirk over denial of a cash payout in lieu of health insurance coverage. In an 11-page ruling last Monday, Chautauqua County Supreme Court Judge Grace Hanlon determined that the city's decision in April to deny that payout was "arbitrary and capricious, an error of law, and in violation of lawful procedure." The court also ruled that the city "is to immediately begin reimbursing [Munson] for her entitled payment for health insurance reimbursement, effective immediately." The city had argued that the payout would be "double dipping."
